What is consent in Context of POSH?
Posh Act |
When a woman objected, refused, or was not modestly dressed, she was assumed to have consented, according to popular belief.
Silence, passivity, or vague behavior is interpreted as agreement, which is not the case!
No means No. Yes means Yes and Silence means “NO”
If the submission is made under duress, intimidation, threat, deception, or the exercising of power, the law implies the absence of consent.
Furthermore, in order to demonstrate unwelcomeness or unwantedness, the complainant would not need to show that she verbally objected, said "No," or communicated in some other manner that his conduct was unacceptable.
It is sufficient for the complainant to show that she expressed her rejection of the perpetrator's advances to him through her behavior, body movement, or body language.
Some of the body language signs indicating NO consent include moving away, not smiling, not engaging, ignoring, changing the subject, showing disinterest, and so on.
